Terms & Conditions of Apartment/Flat in JLPL Regency Heights in Janta Township, Sector 90-91, Mohali by Janta Land Promoters Limited.

2. Application Form
Application forms alongwith terms & conditions can be had from the branches of the Punjab National Bank as per the attached list and also from the office of the Janta Land Promoters Limited, SCO 522-524, Sector-70, Mohali on payment of Rs.200 in cash or Demand Draft drawn in favour of Janta Land Promoters Limited, Mohali. Application form alongwith terms & conditions can also be had through post by sending a Demand Draft of Rs. 250/- including postal charges.
The applications duly filled complete in all respect alongwith prescribed earnest money in the shape of bank draft in favour of Janta Land Promoters Limited should be submitted to the Janta Land Promoters Limited, SCO 522-524, Sector-70, Mohali or to the bank authorized by the Company. The applications without earnest money received before/or after the closing date shall not be entertained and shall be deemed to have been rejected.

3. Eligibility
Any person, who is a citizen of India or Non-Resident Indian or Person of Indian origin shall be eligible to apply and get allotment of a apartment. Multiple applications are allowed by an individual, but he will be alloted only one apartment.
4. Mode of allotment
The eligibility for allocation of the apartment shall be determined after short listing the applicants eligible for allocation through draw of lot, if the number of applications are more than the number of apartments offered, otherwise allocation will be made on first come first served basis. Five percent waiting list shall also be maintained while short listing eligible applicants through draw of lot and this list will be maintainable for six months from the date of holding draw and thereafter it will be deemed to have been lapsed. However, flat number alongwith floor number shall further be allocated through draw of lot and thereafter applicants shall be sent Flat Buyer Agreement, which will have to be signed on the legal paper & returned by the applicant within 30 days of its receipt, failing which, the allocated flat through draw of lot shall be deemed to be cancelled. On receipt of Flat Buyer Agreement, allotment letter shall be issued to the applicant, provided updated payment has been made by the applicant. Draw for the allotment of flat shall be held irrespective of the floors, however,
a)
For Ground and 1st floor, 10% and 5% extra price shall be charged respectively. However, from the 2nd floor to the 13th floor Rs. 10,000/- shall be reduced in price for each floor.
b)
The Buyer shall be bound to accept allotment of the apartment through draw of lot if held. In case of refusal within 30 days of the date of draw, only 2% of the earnest money shall be forfeited and in case of refusal after 30 days, 10% of the earnest money shall be forfeited and balance shall be refunded without any interest.
5. Specifications
Construction shall be broadly as per specifications described in Brouchure.
6. Price and mode of payment
a)
The consideration amount of the apartment includes the basic price of the Super Area of the apartment plus other charges payable as described in the price list annexed with the application form.
b)
Timely payment of installments shall be the essence. Delay in payments may attract cancellation of allotment of flat and forfeiture of earnest money. However, delay in payment may be condoned by the Seller Company by charging at interest @ 15% per annum on the amount overdue.
c)
All payment shall be made either by electronic mode or by account payee cheque (s) / demand draft (s) payable at Mohali in favour of Janta Land Promoters Limited or to the branches of the authorized banks. All payments are subject of realization of demand draft (s) /cheque (s). In case the due date of the payment happens to be bank holiday, the payment should be made on the succeeded date.
7. Facilities

Operation & maintenance of project for a period of three years from the date of handing over possession of the apartment.
8. Handing over of possession
a)
The possession of the apartment shall be handed over complete in all respect and ready for occupation within 24 months from the date of issue of allotment letter. However, while handing over the possession of the apartment, complete list of fitting & fixture shall be handed over to the Buyer.
b)
Construction of the residential apartment is likely to be completed within a period of 24 months from the date of allotment but shall be subject to force majeure and circumstances beyond the control of developers shall not be counted towards the said period of 24 months.
c)
In case possession of the flat is not offered to the Buyer within a period of 24 months from the date of issue of allotment letter or extended period in sub-clause (b) above, the Buyer shall be entitled to receive compensation @ Rs.10/- per.sq.ft. of the area of the apartment per month and to no other compensation of any kind. In case the Buyer fails to clear his account and take possession of the apartment within 30 days of the offer, the Buyer shall be liable to pay holding charges @ Rs.10/- per sq.ft of the area of the Apartment per month in addition to liability to pay to the Janta Land Promoters Limited and other consequences of default in payment.
d)
If as a result of any eventuality, the company is unable to allot the apartment to the Buyer, the Company shall be liable to refund the Buyer, the amount received from the Buyer along with the interest at the term deposited rate of the Bank, as applicable on the date of refund.
9. Operation and maintenance of the complex
a)
All Estates services and infrastructure development, such as parks, green areas, common areas, gymnasium, garbage collection, disposal, facilities for lighting, water, security, waste management and gardening etc. shall be managed by the developer company or by a professional agency to be engaged by the developer on a self sustainable basis. The developer company may modify, repair or otherwise make improvement to the project in accordance with the specification and in accordance with the good industry practice, applicable Indian Laws and Indian directive for that purpose do all such acts and deeds and things necessary and expedient.
b)
The Buyer shall pay the compulsory maintenance fund (for three years) to the extent of Rs.0.50 lacs. in lumpsum before taking over possession of the flat and for operation of maintenance for the common facilities and infrastructure such as park, green areas, roads, common areas, gymnasium, garbage collection, disposal facilities, lighting, water, security, waste management and gardening etc.
c)
i)
Buyer shall pay Rs.0.25 lacs. towards one time compulsory membership fee of the gymnasium attached with the Residential Apartment at the time of taking over possession of the flat. However, this facility under this membership shall last till the ownership of the apartment is vested with the allottee. On the transfer of the apartment by the Buyer the benefits of the membership of the gymnasium shall automatically transfer to the subsequent Buyer. The Developer in consultation with the management of the gymnasium which would have adequate representation of Residential Apartment holders shall be entitled to enroll members of the gymnasium from outside i.e. other than the Buyer or occupants of the complex on payment basis.
ii)
The Developer Company shall execute Tripartite Agreement with the Banks/Financial Institutes for facilitating the financial assistance to the bonafide Buyer and shall also execute the Sale Deed in favour of the Buyer as per the provisions of Punjab Apartment & Ownership Act’ 1995.
iii)
Car parking shall be compulsory for all allottees and Rs.1,00,000/-will be charged for compulsory car parking at the time of taking over possession and for additional space of car parking, Rs.1,50,000/- shall be charged. None of the applicants/allottees shall be allowed to park his/her second car without owning the second space for car parking and also will not be allowed to park his/her second car within the premises of the complex or within the reserved car parking space for the visitors and if second car is found being parked in the visitors parking or otherwise, a heavy fine of Rs. 1000/- shall be charged from the violator for each violation. This charge will be applicable for three years from the date of handing over possession and which will be further reviewed thereafter.
iv)
Company will maintain the complex for three years from the date of handing over possession and thereafter the entire responsibility of maintaining the complex shall be of the duly formed Residents Welfare Association of the complex as the complex will be transferred for all intents and purposes with all assets and liabilities to the association of the Residents of the complex. Developer company shall transfer the entire fund collected by the company to the association for further maintenance of the complex, which will be wholly responsible for all subsequent maintenance of the complex.
10. Handling over of the colony to Resident Welfare Association
of the complex of JLPL Regency Heights, Sector 90-91, Mohali.
After completing the development works of the entire project and after the expiry of three year from the date of handing over possessions to the applicant/allottee of the apartment, company will not bear any charge on account of maintenance and JLPL Residency Heights Complex will be handed over to the duty formed Residents Welfare Association of the complex and entire fund collected from the allottees an account of maintenance will be transferred to the association for further upkeep and maintenance of the colony and company shall not be held responsible in anyway after the expiry of three years as specified above. The association will be formed as per the provisions of the Punjab Apartment & Ownership Act’ 1995 and which will carry its functioning as per the statutory provisions of law.
